Client responsibilities

In order to deliver the project to you on time, the client must:

• Submit all information, project requirements, content, images, logos, and credentials on time as they are needed and requested.
• Review and approve the deliverables within a reasonable amount of time.
• Own the rights to any content submitted to GoSitefy.

If due to the missing of information, lack of approval, or client change, the delivery time would likely be pushed back.

Project Revisions

We understand that revisions can sometimes be required throughout a project:

Certain number of revisions may be included, depending on your selected service package. If a requested modification substantially alters the original approved scope of work, it can be considered an additional work and charged separately.

GoSitefy reserves the right to determine whether a requested revision is within the scope of work defined in your chosen package.

Payment terms

All payments must be made according to the agreed payment schedule prior to the start of a project.

Unless stated otherwise:

• Any advance payment is non-refundable after the work has been started.
• Failure to make payments on time can result in the suspension of work on your project.
• Final project files, website login details or marketing assets cannot be provided until all outstanding balance is settled.
• The client is responsible for any applicable taxes, transaction fees or banking charges.

SEO and Marketing disclaimer

While we always use and implement industry best practices and tested digital marketing strategies to deliver projects to our clients, we are not able to:

• Guarantee a particular position of the site in the search engine results.
• Guarantee an exact traffic number or number of leads.
• Guarantee a particular sales number.
• Guarantee any outcome from advertising campaigns.

Search engines, ad platforms and markets are constantly changing and are outside of our control.

All results of digital marketing depends on numerous factors such as competition, market trends, website design and content quality, ad budget, and client’s audience behavior.

Intellectual Property Rights

Upon the completion of full payment, the client will own the final approved work deliverables that are specific to the project (unless it is agreed differently in writing).
However, GoSitefy remains the sole owner of all in-house processes, software, templates, methods and previous work of intellectual property.
GoSitefy may display the project on our portfolio, case studies, presentations, marketing materials etc, unless there’s another confidentiality agreement.

Third Party Platforms

Most services rendered require us to use third party platforms like, hosting providers, domain registrars, payment gateways, analytical tools, social media websites, ad platforms, etc.
We are not responsible for the downtime of a particular service, suspended account, restricted platform, service interruption or changes in external platform terms and conditions.
Client should review the term and policies of any third party platforms that they are using.

Confidentiality

Both parties agree to maintain strict confidence of confidential information and not to disclose it to third parties.
Confidential Information include (but is not limited to): business plans, marketing strategy, login credentials, financials, customer data and other private business information.
This term of use continues after the completion of the project.

Limitation of Liability

To the maximum extent permitted by law, GoSitefy will not be liable for any indirect, incidental, special, consequential, or business losses incurred by the client through the use of our services.
These losses could be related to:

• loss of revenue or profits
• business interruption
• loss of data
• SEO ranking fluctuations
• issues with the ad accounts

Our total liability will not exceed the amount paid to GoSitefy for the specific services under the claim.

Termination of services

A service agreement can be terminated by either party by giving written notice.

Once terminated:

• The completed work until the point of termination will be billable.
• All outstanding balance will become immediately due and payable.
• Any client materials, finished work, credentials etc will not be delivered until the client has settled all pending balances.

GoSitefy will have the right to terminate services in the case where the client is acting abusively, illegally, fraudulently, or is repeatedly breaching the stated terms.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of India.
Any dispute, controversy or claim arising out of or relating to the use of our website or service shall be subject to the jurisdiction of the proper courts situated in India.
